RESOLUTION NO. RS2001-781

A resolution authorizing the Department of Law to compromise and settle the lawsuit of BellSouth Telecommunications, Inc. against The Metropolitan Government of Nashville and Davidson County in the amount of $28,066.90.

Whereas, plaintiff, BellSouth Telecommunications, Inc., was damaged when an employee of the Metropolitan Government severed fiber optics cables belonging to the plaintiff while operating a mowing machine; and

Whereas, BellSouth filed suit to recover the damages to the fiber optics cables, including the costs of repairing and replacing the cables; and

Whereas, BellSouth has provided detailed accounting of all costs expended on this repair; and

Whereas, the Metropolitan Department of Law believes that a settlement of twenty eight thousand sixty-six and 90/100 dollars ($28,066.90) is a fair and reasonable settlement and recommends that this claim be compromised and settled.

Now therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of BellSouth Telecommunications, Inc. against the Metropolitan Government for the amount of twenty eight thousand sixty-six and 90/100 dollars ($28,066.90) and that said amounts should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
