A resolution authorizing the Metropolitan Mayor to enter into Agreement No. CSX-042021 with CSX Transportation for Metro's Project No. 01-WG-78, Vicinity of Benton Avenue, south of Wedgewood Avenue.

WHEREAS, the CSX Railroad Corporation ("CSX") owns and maintains railroad tracks in Davidson County; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services (the "Department") needs to install a water line in existing railroad right-of-way at Valuation Station 2572 + 60, Milepost 000-188.58, Nashville Terminal Subdivision; and

WHEREAS, CSX proposes to permit the Department to install a water line in the railroad right-of-way in connection with a capital project to replace an existing water line some 725' south of the center line of Wedgewood pursuant to the terms of the agreement (the "Agreement") attached to this resolution as Exhibit A; and

WHEREAS, this agreement can be processed by resolution as authorized by Ordinance No. 098-1393; and

WHEREAS, Emergency Procurement No. 377 has been issued to install this water line due to a notice received from the Metropolitan Fire Marshal.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor or his designee is hereby authorized to execute Agreement No. CSX-042021, a copy attached.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
