A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 5756 with the State of Tennessee, Department of Transportation, for Distribution and Collection System Relocations, said construction being necessary as part of State Project No. STP-M-3251(1), 19958-3784-54, West Trinity Lane from 2300 Ft. West of Buena Vista Rd. to 600 Ft. East of SR-65/US-431 (White's Creek Pike) (Metro Project Nos. 99-SG-164 & 99-WG-150).

WHEREAS, in order for the Tennessee Department of Transportation to construct State Project No. STP-M-3251(1), 19958-3784-54, West Trinity Lane from 2300 Ft. West of Buena Vista Rd. to 600 Ft. East of SR-65/US-431 (White's Creek Pike); and

WHEREAS, the estimated cost for the distribution and collection system relocation to the Department of Water and Sewerage Services is $1,865,880.00 (100%) of the total cost; and

WHEREAS, the Tennessee Department of Transportation desires to start construction of said project and has submitted Utility Relocation Contract No. 5756, attached hereto as Exhibit A and made a part of this resolution by reference, for the adjustments or construction of said water & sewer lines and facilities; and

WHEREAS, The Metropolitan Government is authorized by Ordinance No. 099-1560 to enter, by resolution, into Utility Relocation Contract No. 5756 with the Tennessee Department of Transportation.

WHEREAS, this work is identified in METRO'S CAPITAL IMPROVEMENTS BUDGET Nos. 96SG0005 and 96WG0005.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute Utility Relocation Contract No. 5756 with the Tennessee Department of Transportation, attached hereto as Exhibit A and made a part of this resolution by reference.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
