RESOLUTION NO. RS2001- 754

A resolution opting out of the extension of hours for sale of alcoholic beverages adopted by rule of the Alcoholic Beverage Commission for the area of the Metropolitan Government.


WHEREAS, T.C.A. § 57-4-203 generally provides that hotels, clubs, motels, convention centers, restaurants, and sports authority facilities may not sell or give away alcoholic beverages between the hours of three o'clock a.m. (3:00 a.m.) and twelve o'clock (12:00) Noon on Sundays; and

WHEREAS, T.C.A. § 57-4-203 (d)(5) authorizes the Alcoholic Beverage Commission of the State of Tennessee by rule to extend the hours for sale of alcoholic beverages; and

WHEREAS, the Alcoholic Beverage Commission has adopted a rule that changes the hours for sale of alcoholic beverages by permitting their sale beginning at 10:00 a.m. on Sundays; and

WHEREAS, T.C.A. § 57-4-203 (d)(5) further provides that the governing body of the Metropolitan Government, by adoption of resolution, may opt out of any extension of hours by the Alcoholic Beverage Commission.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council, pursuant to T.C.A. § 57-4-203 (d)(5) hereby opts out of the extension of hours permitted by rule adopted by the Alcoholic Beverage Commission extending the hours for sale of alcoholic beverages within the area of the Metropolitan Government.

SECTION 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to the Alcoholic Beverage Commission of the State of Tennessee.

SECTION 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
