RESOLUTION NO. RS2001-659

A resolution increasing pension benefits payable under Article 48 of Chapter 246 of the Private Acts of 1947, as subsequently amended (City Pension Plan), and Chapter 274 of the Private Acts of 1943, as subsequently amended (County Pension Plan), for certain retired members and survivors of members of the aforementioned pension systems, as provided by Section 13.09.1 of the Metropolitan Charter.

Whereas, the Metropolitan Council previously passed Resolution RS2000-277 requesting the Employee Benefit Board, the Director of Finance and the Mayor to submit a resolution increasing the amount of benefits under the retirement plans for the former City of Nashville and County of Davidson as listed in Section 13.09(a)-(c) of the Metropolitan Charter; and

Whereas, Section 13.09.1 of the Metropolitan Charter provides a method to increase benefits to members, retired members and survivors of members of the retirement plans for the former City of Nashville and the County of Davidson; and

Whereas, the increase in benefits has been approved and recommended by the Employee Benefit Board pursuant to Section 13.09.1 of the Metropolitan Charter; and

Whereas, the Director of Finance has reviewed the recommendation and forwarded his recommendation to the Mayor with a statement of full budgetary implications pursuant to Section 13.09.1 of the Metropolitan Charter; and

Whereas, the Mayor has reviewed the plan as submitted to him and forwarded to the Metropolitan Council with a recommendation that it be adopted effective at the beginning of the next fiscal year pursuant to Section 13.09.1 of the Metropolitan Charter.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. Those persons receiving benefits under paragraph four, five, or ten of Article 48 of Chapter 246 of the Private Acts of 1947, as amended (City of Nashville), or Sections 2.11, 2.12, 2.13, 2.14, 2.15, 2.16, 2.18, 2.19, 2.20, 2.21, 2.26, or 2.27 (County A), or Sections 3.09, 3.10, 3.11, 3.12, 3.13, 3.14, 3.15(c), 3.15(e), 3.15(f), 3.16, or 3.17 (County B) of Chapter 274 of the Private Acts of 1943 (County of Davidson), all as amended, shall be entitled to an increased benefit of $50.00 per month as of July 1, 2001 provided they were eligible for and receiving benefits as of June 30, 2001.

Section 2. Beginning July 1, 2002 and continuing each subsequent July 1st, those persons receiving benefits under paragraph four, five, or ten of Article 48 of Chapter 246 of the Private Acts of 1947, as amended (City of Nashville), or Sections 2.11, 2.12, 2.13, 2.14, 2.15, 2.16, 2.18, 2.19, 2.20, 2.21, 2.26, or 2.27 (County A), or Sections 3.09, 3.10, 3.11, 3.12, 3.13, 3.14, 3.15(c), 3.15(e), 3.15(f), 3.16, or 3.17 (County B) of Chapter 274 of the Private Acts of 1943 (County of Davidson), all as amended, shall be entitled to a benefit equal to the benefit payable the immediately proceeding month plus an amount equal to the percentage of increase in the Consumer Price Index to the nearest one-half percent for the twelve months ending on March 31st in the calendar year for which the increase shall apply. The total yearly increase pursuant to this section shall not exceed five percent per year.

Section 3. This resolution shall take effect on July 1, 2001, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
