RESOLUTION NO. RS2001-653

A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 5712 with the State of Tennessee, Department of Transportation, for the necessary construction of certain utilities as part of State Project No. BR-STP-3245(1), 19958-2792-94, involving Gateway Blvd. from First Ave. (SR-24) South to South First Street and Metro Project Nos. 99-SG-182 and 99-WG-177.

WHEREAS, in order for the Tennessee Department of Transportation to construct State Project BR-STP-3245(1), 19958-2792-94 involving Gateway Blvd. from First Ave. (SR-24) South to South First Street, it is necessary to adjust or construct certain water lines and/or sewer lines; and

WHEREAS, the estimated cost for the adjustment or construction of the water and/or sewer lines or facilities to the Department of Water and Sewerage Services is $120,971.00, said amount to be reimbursed to the Tennessee Department of Transportation; and

WHEREAS, the Tennessee Department of Transportation desires to start construction of said project and has submitted Utility Contract No. 5712, attached hereto as Exhibit A and made a part of this resolution by reference, for the adjustment or construction of the water and/or sewer lines or facilities; and

WHEREAS, the Metropolitan Government is authorized by Ordinance No. 093?743 to enter, by resolution, into Utility Relocation Contract No. 5712 with the Tennessee Department of Transportation; and

WHEREAS, this work is identified in Metro's Capital Improvements Budget as Project No. 96WG0005.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is authorized to enter into Utility Contract No. 5712 with the Tennessee Department of Transportation, attached hereto as Exhibit A and made a part of this resolution by reference.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
