RESOLUTION NO. RS2001-626

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to accept a supplemental easement from the U.S. Army Corps of Engineers in connection with the reconstruction, operation, and maintenance of a public road.

Whereas, The Metropolitan Planning Commission at its meeting on February 17, 2000, approved a subdivision plan for South Shore (Map 165, Parcel 11); and,

Whereas, construction of this subdivision will require reconstruction, operation, and maintenance of a roadway; and,

Whereas, said roadway will cross a portion of Tract 738 within the confines of the J. Percy Priest Dam and Reservoir Project; and

Whereas, an easement from the U.S. Army Corps of Engineers is necessary for crossing the above described portion of Tract 738; and,

Whereas, the Metropolitan Council by Resolution RS2000-307 authorized an agreement with the U.S. Army Corps of Engineers, which, inter alia, accepted an easement from the Corps; and,

Whereas, an additional easement has been found necessary for the project and the Corps is willing to grant such an easement,

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The supplemental easement with the U.S. Army Corps of Engineers attached hereto is approved and the Metropolitan Mayor is authorized to accept and sign such easement.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
