RESOLUTION NO. RS2001-586

A resolution approving an interlocal agreement between the Metropolitan Government, the Electric Power Board of the Metropolitan Government, and the City of Berry Hill for access to 800-MHZ for emergency radio dispatching and response.

Whereas, The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the Electric Power Board of The Metropolitan Government of Nashville and Davidson County ("N.E.S.") jointly own and operate an emergency radio dispatch and response system utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission ("F.C.C."); and,
Whereas, the City of Berry Hill ("Berry Hill") also has the use of 800-MHZ radio frequencies licensed by the F.C.C.; and
Whereas, Berry Hill wishes to have access to the 800-MHZ radio frequencies licensed to the Metropolitan Government and N.E.S.; and,
Whereas, the Metropolitan Government and N.E.S. wish to have access to the 800-MHZ radio frequencies licensed to Berry Hill; and,
Whereas, the Metropolitan Government, N.E.S. and Berry Hill have agreed upon the terms of an interlocal agreement whereby each party grants access to their respective 800-MHZ radio frequencies; and,
Whereas, Tennessee Code Annotated, Section 12-9-104, provides that interlocal agreements between governments may be approved by resolution.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. That the Interlocal Agreement by and between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and the City of Berry Hill for access to their respective 800-HMZ radio frequencies solely for public safety purposes, and for a term extending through June 30, 2005, be and the same is hereby approved and the Metropolitan Mayor is hereby authorized to execute said Interlocal Agreement.
Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
