A resolution authorizing conveyance of a temporary construction easement to the State of Tennessee, Department of Transportation

Whereas, Ordinance O93-743 approved an agreement between The Metropolitan Government of Nashville and Davidson County ("the Metropolitan Government") and the State of Tennessee, Department of Transportation ("the State"), providing for management, funding and related matters concerning project BR-STP-3245(1), Bridge & Approaches on Shelby Ave. over Cumberland River ("the Project"); and

Whereas, Ordinance O93-743 provided that additional contracts for said the Project be ratified by resolution of the Metropolitan County Council; and

Whereas, the Metropolitan Government desires to convey to the State a temporary construction easement authorizing its entry into certain property owned by the Metropolitan Government for purposes of performing construction activities related to the Project,

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Public Property Manager of the Metropolitan Government is authorized to execute the attached Temporary Construction Easement.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
