RESOLUTION NO. RS2001-489

A resolution authorizing the Department of Law to compromise and settle the lawsuit of James Head and Tonya Ervin-Head against the Metropolitan Government in the amount of $12,000.00 and directing that this amount be paid out of the Self-Insured Liability Fund.

Whereas, plaintiffs James Head and Tonya Ervin-Head were injured as a result of being struck by a Metropolitan Police Department vehicle driven by Officer William Davenport on April 25, 2000; and,

Whereas, James Head and Tonya Ervin-Head incurred expenses and lost wages as a result of said automobile accident; and,

Whereas, James Head and Tonya Ervin-Head were not at fault in the accident; and

Whereas, the Metropolitan Department of Law believes that a settlement of Twelve Thousand ($12,000.00) Dollars is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit of James Head and Tonya-Ervin Head against the Metropolitan Government for the amount of Twelve Thousand ($12,000.00) Dollars and that said amount should be paid from the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
