RESOLUTION NO. RS2000-456

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the U.S. Army Corps of Engineers concerning construction and maintenance of certain turn lanes on Bell Road and Dodson Chapel Road and accepting an easement for said purpose.

Whereas, The Metropolitan Government of Nashville and Davidson County proposes to maintain certain turn lanes on Bell Road and Dodson Chapel Road when construction thereof is complete; and,

Whereas, the construction of this improvement will require that new roadway side slopes extend outside the right-of-way and into property of the U.S. Army Corps of Engineers; and,

Whereas, said roadway will cross a portion of Tracts 129 and 131-1 within the confines of the J. Percy Priest Dam and Reservoir Project; and,

Whereas, an easement from the U.S. Army Corps of Engineers is necessary for crossing the above described portion of Tracts 129 and 131-1; and,

Whereas, the attached agreement conveys the necessary easement from the Corps of Engineers to the Metropolitan Government, in consideration of the agreement to construct, operate and maintain said roadway; and,

Whereas, TCA section 12-9-101 et. Seq. authorizes the approval of such agreements by resolution of the Metropolitan Council,

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The attached agreement with the U.S. Army Corps of Engineers is approved; and the Metropolitan Mayor is authorized to execute said agreement.

Section 3. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
