RESOLUTION NO. RS2000-454

A resolution authorizing the Metropolitan Mayor to enter into Agreement No. CSX-039115 with CSX Transportation for Metro's Project No. 96-SG-110A, Mill Creek Trunk Sewer Upgrade.

WHEREAS, the CSX Railroad Corporation ("CSX") owns and maintains railroad tracks in Davidson County; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services (the "Department") needs to construct sewer lines in existing railroad rights-of-way at Valuation Station 65+59, Milepost OBA-186.70, for Project No. 96-SG-110A (the "Project"); and

WHEREAS, CSX proposes to permit the Department to construct sewer lines in railroad rights-of-way in connection with the Project pursuant to the terms of the agreement (the "Agreement") attached to this resolution as Exhibit A; and

WHEREAS, this agreement can be processed by resolution as authorized by Ordinance No. 098-1393; and

WHEREAS, funding for Project No. 96-SG-110A, Mill Creek Trunk Sewer Upgrade, is included in the Capital Improvements Budget as No. 97SC0001.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor or his designee is hereby authorized to execute Agreement No. CSX-039115, a copy attached.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
