RESOLUTION NO. RS2000-441

A resolution ratifying a contract between the State of Tennessee, Nashville & Eastern Railroad Corporation, and The Metropolitan Government of Nashville and Davidson County in respect of Project No. BR-STP-3245(1), 19958-2792-94; Gateway Boulevard Bridge.

Whereas, The Metropolitan Government of Nashville and Davidson County acting through its Department of Public Works hereinafter sometimes referred to as the "City" has recommended replacement of the Shelby Avenue Bridge with the Gateway Boulevard Bridge under the 23 U.S.C.A., Section 144, Highway Bridge Replacement and Rehabilitation Program Program; and

Whereas, The State of Tennessee, acting through its Department of Transportation hereinafter referred to as the "State" has allocated funds for the following project:

BR-STP-3245(1), 19958-2792-94; Gateway Boulevard Bridge and approaches over Cumberland River, 19-M3245-1.78.

Whereas, Project BR-STP-3245(1), 19958-2792-94 provides for the relocation of the Nashville & Eastern Railroad Corporation, hereinafter referred to as the "Railroad" facilities and construction of a highway bridge structure and approaches to carry Gateway Boulevard over the tracks of the Railroad at Mile Post NT-0.36 within the City (hereinafter referred to as the "Project"); and

Whereas, the State and City have negotiated an agreement for the Gateway Boulevard Bridge and approaches with the Railroad; and

Whereas, the State and the City have agreed to cooperate in constructing the Project, and the City has agreed to assume ownership and the responsibility to maintain the Project; and

Whereas, the Railroad agrees to cooperate with the State and the City in the construction and maintenance of the Project;

Whereas, Ordinance No. O93-743 authorizes the acceptance of project No. BR-STP-3245(1), 19958-2792-94, Replacement of the Shelby Avenue Bridge; and

Whereas, Ordinance No. O93-743 authorizes the Metropolitan County Mayor to execute contracts necessary of the Project; and

Whereas Ordinance No. O93-743 also requires that any additional contracts for the Project be ratified by resolution of the Metropolitan County Council prior to execution by the Metropolitan County Mayor; and

Whereas, it is in the best interest of the Metropolitan Government that said contract be approved and that the Metropolitan Mayor be authorized to execute said contract.

Now Therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the Contract between the State, the Railroad and the City concerning Project No. BR-STP-3245(1), 19958-2792-94 which attached hereto and made a part of this Resolution, be and the same is hereby ratified by adoption of this Resolution.

Section 2: That the Metropolitan County Mayor is authorized to execute the attached contract for Project No. BR-STP-3245(1), 19958-2792-94.

Section 3: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
