RESOLUTION NO. RS2000-424

A resolution authorizing the Metropolitan Government to enter into an agreement with the University of Tennessee Center for Industrial Services for development and implementation of an educational course on erosion and sediment control.

Whereas, the University of Tennessee Center for Industrial Services (UTCIS) desires to implement an educational course on erosion and sediment control for municipal and other inspectors, plans reviewers and similar officials ("the course"); and

Whereas, the Metropolitan Government of Nashville and Davidson County ("the Metropolitan Government") desires to contribute $5,000.00 to be used to defray the cost of developing the course; and

Whereas, in consideration of said contribution, UTCIS will provide a tuition credit to the Metropolitan Government in connection with attendance at the course; and

Whereas, the Metropolitan Government is required, as part of its NPDES permit, to provide erosion and sediment control training for its inspection personnel as well as contractors, developers, engineers and others involved in the erosion control process; and

Whereas, TCA § 12-9-108 authorizes agreements for services between a state agency and a political subdivision of the state;

Now, therefore, be it resolved by the Council of the Metropolitan Government of Nashville and Davidson County:

SECTION 1. The Agreement between the Metropolitan Government and UTCIS attached hereto is approved, and the Metropolitan Mayor is authorized to execute said agreement.

SECTION 2. This resolution shall take effect from and after its passage, the welfare of the Metropolitan Government requiring it.
