RESOLUTION NO. RS2000-423

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the U.S. Army Corps of Engineers for the purpose of installation, operation, and maintenance of a box culvert, drainage pipes and roadway and accepting an easement for said purpose.

Whereas, The Metropolitan Planning Commission at its meeting on February 17, 2000, approved a subdivision plan for South Shore (Map 165, Parcel 11); and,

Whereas, construction of this subdivision will require the installation, operation, and maintenance of a dual 2'x8' reinforced concrete box culvert, rip-rap for culvert, drainage pipe and roadway; and,

Whereas, said facilities will be located in Tracts 1148 and 1149E within the confines of the J. Percy Priest Dam and Reservoir Project; and

Whereas, an easement from the U.S. Army Corps of Engineers is necessary for crossing the above described portion of Tracts 1148 and 1149E; and,

Whereas, the attached agreement conveys the necessary easement from the Corps of Engineers to the Metropolitan Government, in consideration of the Metropolitan Government's agreement to install, operate and maintain said facilities; and,

Whereas, TCA section 12-9-101 et. Seq. authorizes the approval of such agreements by resolution of the Metropolitan Council,

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The attached agreement with the U.S. Army Corps of Engineers is approved; and the Metropolitan Mayor is authorized to execute said agreement.

Section 3. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
