RESOLUTION NO. RS2000-389
A resolution authorizing the Metropolitan Mayor to enter into Agreement No. CSX-039116 with CSX Transportation for Metros Project No. 95-SC-14, Dry Creek/Armstrong Sewer Rehabilitation.
WHEREAS, the CSX Railroad Corporation ("CSX") owns and maintains railroad tracks in Davidson County; and
WHEREAS, the Metropolitan Department of Water and Sewerage Services (the "Department") needs to construct sewer lines in existing railroad rights-of-way at Valuation Station 1890+15, Milepost 000-175.64, for Project No. 95-SC-14 (the "Project"); and
WHEREAS, CSX proposes to permit the Department to construct sewer lines in railroad rights-of-way in connection with the Project pursuant to the terms of the agreement (the "Agreement") attached to this resolution as Exhibit A; and
WHEREAS, this agreement can be processed by resolution as authorized by Ordinance No. 098-1393; and
WHEREAS, funding for Project No. 95-SC-14, Dry Creek/Armstrong Sewer Rehabilitation, is included in the Capital Improvements Budget as No. 96-SC-0019.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Mayor or his designee is hereby authorized to execute Agreement No. CSX-039116, a copy attached.
SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
