RESOLUTION NO. RS2000-387

A resolution approving an amendment to a lease between the Metropolitan Government and the Nashville Zoo for a parcel of property commonly known as Grassmere.

WHEREAS, pursuant to Ordinance No. O96-473, the Metropolitan Council approved a lease (the "Lease") between the Metropolitan Government and the Nashville Zoo for the property commonly known as Grassmere; and

WHEREAS, the parties desire to amend the Lease and exclude a parcel not to exceed 18 acres from the leased premises, in accordance with the terms and conditions set forth in the document attached as Exhibit A and incorporated into this Ordinance by reference; and

WHEREAS, the excluded parcel of land will be used as the site for a new school; and

WHEREAS, the citizens of Nashville and Davidson County will benefit from the approval of the amendment to the Lease.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The proposed amendment to the Lease between the Metropolitan Government and the Nashville Zoo (Exhibit A) is hereby approved.

Section 2. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

RESOLUTION NO. RS2000-387

Mr. President:

I move to amend Resolution No. RS2000-387 by amending Section 1 by adding the following:

"Not more than eighteen (18) acres identified in the first amendment to the lease agreement approved herein shall be excluded from this lease for use for school purposes, unless such additional property is approved and duly adopted by ordinance of the Metropolitan County Council."
