RESOLUTION NO. RS2000-386

A resolution approving Amendment No. 1 to the Agreement for operation of a foreign trade zone between The Metropolitan Government of Nashville and Davidson County and Irish Express Logistics, Incorporated.

Whereas, Ordinance No. BL99-120 approved an Agreement for operation of a foreign trade zone (Agreement) between The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and Irish Express Logistics, Incorporated ("Irish Express"); and,

Whereas, the Agreement approved by Ordinance No. BL99-120 did not provide for manufacturing within the foreign trade zone or for any related payment to the Metropolitan Government; and,

Whereas, Irish Express requested approvals of the United States Foreign Trade Zones Board ("Board") and from the Metropolitan Government to allow manufacturing activities within the foreign trade zone; and,

Whereas, Irish Express has received the approval of the Board and only needs the approval of the Metropolitan Government; and,

Whereas, Irish Express and the Metropolitan Government have negotiated an Amendment No. 1 to the Agreement to provide for manufacturing within the foreign trade zone and for an annual payment of $20,000.00 to the Metropolitan Government; and,

Whereas, Ordinance No. BL99-120 provides that the Agreement may be amended by resolution.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County.

Section 1. That Amendment No. 1 to the Agreement for operation of foreign trade zone No. 78 by and between The Metropolitan Government of Nashville and Davidson County and Irish Express Logistics, Incorporated, which Amendment No. 1 provides that manufacturing activities may be conducted in the foreign trade zone and for an annual payment of Twenty Thousand ($20,000.00) Dollars to the Metropolitan Government for an administrative fee, with all other provisions of said Agreement remaining unchanged, be and the same is hereby approved and the Metropolitan Mayor is authorized to execute said Amendment No. 1.

Section 2. That this resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
