RESOLUTION NO. RS2000-385

A resolution ratifying an agreement between the Tennessee Department of Transportation and The Metropolitan Government of Nashville and Davidson County relating to Project No. STP 1(122), the construction of improvements to the Briley Parkway/Murfreesboro Road interchange.

Whereas, the Transportation Improvement Program (TIP) provides for the construction of improvements to the Briley Parkway/Murfreesboro Road interchange with federal STP funds, previously called Federal-Aid Urban System Funds; and,

Whereas, The Metropolitan Government of Nashville and Davidson County and the Tennessee Department of Transportation have agreed that the Metropolitan Government will reallocate $7,000,000.00 in federal STP funds from other projects to State Project No. STP-1(122), improvements to the Briley Parkway/Murfreesboro Road interchange; and,

Whereas, the reallocation of federal STP funds is an element of an agreement with the State of Tennessee to secure $7,000,000.00 in funding for the rehabilitation of the Shelby Avenue Bridge as a pedestrian walkway; and,

Whereas, Ordinance No. 76-242 authorizes the Metropolitan Mayor to execute agreements necessary to implement Federal-Aid Urban System projects; and,

Whereas, Ordinance No. 76-242 also requires that contracts for Federal-Aid Urban System projects be ratified by resolution of the Metropolitan Council.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County.

Section 1. That the contract submitted by the Department of Transportation of the State of Tennessee to The Metropolitan Government of Nashville and Davidson County to complete construction of improvements to the intersection of Briley Parkway/Murfreesboro Road, Project No. STP-1(122), with a contribution of $7 Million Dollars by the Metropolitan Government, be and the same is hereby ratified and the Metropolitan Mayor is hereby authorized to execute said contract.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
