RESOLUTION NO. RS2000-384

A resolution approving an amendment to the Memorandum of Understanding between The Metropolitan Government of Nashville and Davidson County, the Sports Authority of The Metropolitan Government of Nashville and Davidson County, and the State of Tennessee for development of a football stadium to increase the funding for the rehabilitation of the Shelby Avenue pedestrian bridge.

Whereas, effective on February 29, 1996, The Metropolitan Government of Nashville and Davidson County ("Metro"), the Sports Authority of The Metropolitan Government of Nashville and Davidson County ("Sports Authority"), and the State of Tennessee ("State"), entered into a Memorandum of Understanding regarding the development of the football stadium ("MOU"); and,

Whereas, Section 2 of the MOU provided that the State would contribute $12 Million Dollars for infrastructure improvements, a portion of which has been used for the rehabilitation of the Shelby Avenue Bridge as a pedestrian walkway; and,

Whereas, Metro needs additional funds to complete the rehabilitation of the bridge; and,

Whereas, the State has agreed to increase, by $7 Million Dollars, its funding of the rehabilitation of the Shelby Avenue Bridge to a pedestrian walkway in exchange for Metro's agreement to commit $7 Million Dollars of its federal funds to the Briley Parkway/Murfreesboro Road interchange; and,

Whereas, Metro, the Sports Authority, and the State have agreed to amend the MOU to increase the State's funding for infrastructure improvements from $12 Million Dollars to $19 Million Dollars; and,

Whereas, Ordinance No. 096-220 approved the MOU and Section 2 thereof provides that amendments to the MOU may be approved by resolution.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County.

Section 1. That the amendment to the MOU between Metro, the Sports Authority, and the State, which amends Section 2 to increase the State's funding for infrastructure improvements from $12 Million Dollars to $19 Million Dollars, is hereby approved and the Metropolitan Mayor is hereby authorized to execute said amendment.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
