RESOLUTION NO. RS2000-352

A resolution accepting $100,000 in compromise and settlement of the Metropolitan Government's claim against Sequatchie Concrete Services, Inc.

Whereas, the Metropolitan Government has asserted a claim against Sequatchie Concrete Services, Inc. for damage to several segments of a 30" reinforced concrete sewer line in an easement across Sequatchie’s property; and

Whereas, Sequatchie has offered to pay to Metropolitan Government the sum of $100,000 in settlement of the Metropolitan Government’s claim; and

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable, and recommends that the claim be compromised and settled in the amount of $100,000;

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to accept the amount of $100,000 in compromise and settlement of its claim against Sequatchie Concrete Services, Inc.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
