RESOLUTION NO. RS2000-335

A resolution requesting the Tennessee Health Facilities Commission to deny the request of Behavioral Health of Nashville, Inc.’s request for a Certificate of Need for a methadone treatment facility at 602 Gallatin Road.

WHEREAS, Behavioral Health of Nashville, Inc., has filed a Certificate of Need, application No. CN 006-043, which seeks to obtain a Certificate of Need to open a methadone treatment facility at 602 Gallatin Road; and

WHEREAS, there presently exists a similar clinic on Hayes Street and a proposed new clinic at Charlotte Avenue, either of which would adequately serve the area, including the proposed site on Gallatin Road; and

WHEREAS, the granting of this Certificate of Need would not promote the health, convenience, safety or general welfare of the inhabitants of the area of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Tennessee Health Facilities Commission to deny the request of Behavioral Health of Nashville, Inc.’s, request for a Certificate of Need for a methadone treatment facility at 602 Gallatin Road.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the Tennessee Health Facilities Commission.

SECTION 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
