RESOLUTION NO. RS2000-314
A resolution approving the First Amendment to the lease between the Metropolitan Government and Watkins Institute for use of the Ben West Library Building.
Whereas, the Metropolitan Government and Watkins Institute have entered into a lease to use the Ben West Library Building after the Nashville Public Library moves into the new Downtown Library; and
Whereas, the lease was approved by Ordinance No. O99-1682 which provided that it could be amended by a resolution receiving a total of twenty-one (21) votes; and
Whereas, the lease recognized that a small portion of the property of the Ben West Library Building was encumbered by a restrictive covenant to the effect that the premises must be used as a library open to the public; and,
Whereas, the lease contemplated that the Metropolitan Government would file a condemnation action funded by Watkins Institute to remove the restrictive covenant so that Watkins Institute would have unrestricted use of the premises as an educational institution; and,
Whereas, Watkins Institute informed the Metropolitan Government that it intends to operate a library open to the public on a portion of the premises; and,
Whereas, the Metropolitan Government and Watkins Institute have agreed to the terms of an amendment to the lease which provides that for so long as Watkins Institute maintains a library open to the public, the Metropolitan Government will not commence proceedings to condemn the restrictive covenant.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the First Amendment to the lease between The Metropolitan Government of Nashville and Davidson County and Watkins Institute, which Amendment is attached hereto and incorporated herein by reference, be and the same is hereby approved and the Metropolitan Mayor is hereby authorized to execute said First Amendment.
Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
