Resolution No.RS2000-308

A resolution authorizing The Metropolitan Government of Nashville and Davidson County to enter into an agreement with the U. S. Army Corps of Engineers for the purpose of accepting a license for a temporary work area for the purpose installing CMP drainage pipe.

WHEREAS, the Metropolitan Planning Commission at its meeting on February 17, 2000 approved a subdivision plan for the Villages of Long Hunter PUD, Phase I (Map 15 1, part of Parcels 40, 41, and 82); and,

WHEREAS, construction of this subdivision will require installation, operation and maintenance of a culvert, ditch and 48" elliptical CMP pipe for drainage purposes; and,

WHEREAS, said pipe will cross a portion of Tract 1106-1 within the confines of the J. Percy Priest Dam and Reservoir Project; and,

WHEREAS, a license from the U.S. Army Corps of Engineers is necessary for the Metropolitan Government to install said pipe; and,

WHEREAS, the attached agreement conveys the necessary license from the Corps of Engineers to the Metropolitan Government in consideration of the Metropolitan Government's agreement to install, maintain, and operate said culvert, ditch and pipe; and,

WHEREAS, TCA § 12-9-101 et seq. authorizes the approval of such agreements by resolution of the Metropolitan Council,

NOW THEREFORE, be is resolved by the Council of The Metropolitan Government of Nashville and Davidson county:

Section 1. The attached agreement with the U.S. Army Corps of Engineers is approved and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. That this Resolution shall take effect from. and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
