RESOLUTION NO. RS2000-297

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of James Gray, III, and Jasmine Dartis, minors, by parent and next friend Hattie Gray; Ashley Gray, deceased, by parents and next-of-kin Hattie Gray and James Gray, Jr.; and Hattie Gray and James Gray, Jr., individually, against The Metropolitan Government of Nashville and Davidson County for $110,000.00, and directing that this amount be paid from the self-insured liability fund.

Whereas, Hattie Gray, James Gray, III, Jasmine Dartis, and Ashley Gray were involved in a vehicular collision with a vehicle being pursued by Metropolitan Police Officers and they sustained personal and, in the case of Ashley Gray, fatal injuries as a result thereof; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Account.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claims of James Gray, III, and Jasmine Dartis, minors under 18, by parent and next friend Hattie Gray; Ashley Gray, deceased, by parents and next-of-kin Hattie Gray and James Gray, Jr.; and Hattie Gray and James Gray, Jr., individually, against The Metropolitan Government of Nashville and Davidson County for the amount not to exceed $110,000.00, which amount should be paid from the Self-Insured Liability Account.

Section 2. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
