RESOLUTION NO. RS2000-295

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Frances Uttilla, Suzanne and J.P. Colsey, Betty. Anderson, Judy Neal, Kevin Lofton, Debra Cunningham and Barbara Atkinson against The Metropolitan Government of Nashville and Davidson County.

Whereas, the Metropolitan Department of Public Works has identified a number of sidewalk curb ramps which are not in complete compliance with the standards set forth in the Americans With Disabilities Act and which may have caused sidewalks under the control of the Metropolitan Government to be inaccessible to persons with disabilities; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Francis Uttilla, Suzanne and J.P. Colsey, Betty Anderson, Judy Neal, Kevin Lofton, Debra Cunningham and Barbara Atkinson by agreeing to design, construct, alter and install the sidewalk curb ramps for which the Metropolitan Government has responsibly in accordance with the standards set forth in the Americans With Disabilities Act, and by agreeing to bring existing curb ramps for which the Metropolitan Government has responsibly into compliance with these ADA standards.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
