RESOLUTON NO. RS2000-277

A resolution requesting the Employee Benefit Board, the Director of Finance, and the Metropolitan County Mayor to submit a resolution to the Metro Council providing for an increase, based upon cost of living increases, for retired members and survivors of the closed city and county pension plans.

WHEREAS, Section 13.09.1 of the Metropolitan Charter provides a method to increase benefits to members, retired members, and survivors of members of the retirement plans for the City of Nashville and County of Davidson; and

WHEREAS, such pensioners have not received an increase in pension benefits since 1997; and

WHEREAS, any increase in pension benefits to those persons receiving benefits under the pension plans provided for in Section 13.09. (a) - (c) may not become effective except at the beginning of each fiscal year; and

WHEREAS, it is fitting and appropriate that such persons receiving benefits under these closed pension plans receive a cost of living increase on an annual basis, the same as persons under other pension plans receive increases.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Employee Benefit Board, the Director of Finance, and the Metropolitan County Mayor are hereby requested to submit to the Metropolitan County Council for its adoption a resolution increasing the amount of benefits being received under the retirement plans listed in Section 13.09. (a) – (c) of the Metropolitan Government effective July 1, 2001, in an amount of $50.00 (fifty dollars) per month. Such resolution should also provide for a cost of living increase annually effective July 1 of each succeeding year, such cost of living increase to be in the same amount as provided for the closed plans for teachers, or the other cost of living increase provisions provided for in the open pension plans of the Metropolitan Government.

SECTION 2. The resolution requested in Section 1 hereof should be submitted to the Metro Council for adoption as soon as reasonably possible to finally resolve the issue of pension benefits for persons in those closed plans.

SECTION 3. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the members of the Employee Benefit Board, the Director of Finance, and the Mayor.

SECTION 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
