RESOLUTION NO. RS2000-227

A resolution authorizing the Metropolitan Department of Law to make an offer of judgment to compromise and settle the claim of Russell Frohmuth against the Metropolitan Government, Officer Anthony Bourk, Officer Samuel Cooley, and Officer Shane Stokes for $10,000.00.

WHEREAS on August 31, 1998, Mr. Russell Frohmuth was allegedly injured while being arrested, and

WHEREAS, a suit was filed by Mr. Frohmuth in the United States District Court for the Middle District of Tennessee (case number 3:99-0852) for the injuries allegedly sustained during his arrest, and

WHEREAS, after investigation, the Department of Law believes the offer of judgment referenced in Section 1 is fair and reasonable and recommends that the amount be paid from the Self Insured Liability Account.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: The Department of Law is authorized to serve an offer of judgment in the case of Russell Frohmuth vs. Metropolitan Government, et al., case number 3:99-0852 in the United States District Court for the Middle District of Tennessee, for $10,000.00 plus reasonable costs accrued to the date of the offer, and, if the offer is accepted, said amounts should be paid from the Self Insured Liability Account.

SECTION 2: This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
