RESOLUTION NO. RS2000-183

A resolution requesting the Mayor, the Metropolitan Development and Housing Agency, and the Department of Codes Administration to review all structures condemned by the Department of Codes as uninhabitable to determine those suitable for affordable housing.

WHEREAS, the Building Code of the Metropolitan Government requires that housing units that are uninhabitable be brought up to code requirements to provide safe housing for the residents; and

WHEREAS, there are numerous properties within the area of the Metropolitan Government that do not meet current Building Codes and are deemed uninhabitable, which may be rehabilitated in order to provide safe and adequate housing; and

WHEREAS, it is fitting and proper that the Department of Codes Administration not demolish any structures deemed uninhabitable until such time as a determination is made that these properties can be rehabilitated, either with public or private funds, so as to provide affordable housing within the area of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Mayor, the Metropolitan Development and Housing Agency, and the Department of Codes Administration to review all structures condemned by the Department of Codes as uninhabitable to determine suitable for affordable housing.

SECTION 2. The Council further requests the Department of Codes Administration to cease demolition of any housing structures that have been deemed uninhabitable until such time as this survey can be completed and a plan composed, unless such housing poses an immediate threat to the health, safety and welfare of the Metropolitan Government.

SECTION 3. The Council requests the Mayor and the Metropolitan Development and Housing Agency to complete this study and provide it to the Metropolitan Council not later than June 15, 2000.

SECTION 4. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to the Mayor, the Executive Director of the Metropolitan Development and Housing Agency, and to the Director of the Department of Codes Administration.

SECTION 5. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

 TO

 RESOLUTION NO. RS2000-183

Mr. President:

I move to amend Resolution No. RS2000-183 by deleting the phrase "not later than June 15, 2000" wherein it appears in Section 3 thereof, and substituting in lieu thereof the phrase "not later than August 15, 2000".
