RESOLUTION NO. RS2000-180

A resolution requesting the Mayor and the Metropolitan Police Department to maintain records on motorists stopped by the police, whether or not those persons are charged or arrested for offenses, and to make such information available to any interested person or group.

WHEREAS, there have been allegations that the Metropolitan Police Department, on a continuing basis, stop motorists based upon race or ethnic ancestry rather than for traffic offenses, or that moving violations are issued based upon some type of racial profile; and

WHEREAS, in order to affirmatively demonstrate that Metro police officers are not engaging in any disparate treatment based upon race, it is fitting and proper that the Metropolitan police department maintain records, including race, age, sex, and any other information deemed necessary, on all persons stopped by the police, whether they are given traffic citations or arrested, to demonstrate that such activity is not occurring within the area of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Mayor and the Metropolitan Police Department to maintain records on all motorists stopped by a police officer whether or not they are issued a traffic citation or arrested, and that such information be made public and easily available to any person or group requested such information. Said information shall include, but not be limited to, sex, age, race, location of the stop, time of day of the stop, and reason for the stop and questioning of the person or persons.

SECTION 2. That the Metropolitan Clerk is directed to send a certified copy of this Resolution to the Mayor and to the Chief of Police.

SECTION 3. That the Mayor and the Chief of Police are further requested to inform The Metropolitan Council of the feasibility and/or the actions taken in compliance with the request contained in Section 1 hereof, not later than sixty (60) days after the adoption of this Resolution.

SECTION 4. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

RESOLUTION NO. RS2000-180

Mr. President:

I move to amend Resolution No. RS2000-180 by deleting the phrase "sixty (60) days" wherein it appears in Section 3 thereof, and substituting in lieu thereof the phrase "ninety (90) days".
