RESOLUTION NO. RS2000-176

A resolution compromising and settling the lawsuit of Vicki Starks, Broderick Starks, and Kenneth Boston against The Metropolitan Government of Nashville and Davidson County for an amount not to exceed $100,000.00 and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, on May 5, 1994, Vicki Starks and Broderick Starks were involved in a collision with another automobile on Burkett Road in Nashville, Davidson County, Tennessee; and,

Whereas, Vicki Starks and Broderick Starts sustained personal injuries and property damages, and Mrs. Starks daughter, Marissa Nichole Boston, was killed and the plaintiffs allege that said accident was caused by road defects; and,

Whereas, the Metropolitan Department of Law believes that a settlement of One Hundred Thousand ($100,000.00) Dollars, is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the Metropolitan Department of Law is authorized to compromise and settle the lawsuit Vicki Starks, Broderick Starks and Robert Boston against the Metropolitan Government for an amount not to exceed One Hundred Thousand ($100,000.00) Dollars and that said amount should be paid from the Self-Insured Liability Fund.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
