RESOLUTION NO. RS2000-130

A resolution electing Nicholas D. Bailey to the board of directors of the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County.

WHEREAS, the Metropolitan County Council has, pursuant to Chapter 53 of Title 7 of the Tennessee Code Annotated, as amended, duly authorized and approved the establishment of The Industrial Development Board of the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, T.C. A., § 7-53-301, as amended, provides that all members of the Board of Directors shall be elected by the governing body of the Metropolitan Government of Nashville and Davidson County; and

WHEREAS, due to the resignation of Mr. Tom Dean from said Board of Directors, it is necessary that the remainder of this term be filled by election of the Metropolitan County Council; and

WHEREAS, Nicholas D. Bailey, has been nominated by John Summers; and

WHEREAS, an election has been conducted pursuant to the Rules of Procedure of the Metropolitan County Council of the Metropolitan Government of Nashville and Davidson County on February 1, 2000, resulting in the election of Nicholas D. Bailey to said position.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. Nicholas D. Bailey, who is an elector of and taxpayer in the Metropolitan Government of Nashville and Davidson County and who is not an officer of or employed by the Metropolitan Government, is hereby elected a director of the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County to fill an unexpired term ending October 7, 2003; provided, however, that if at the expiration of said term of office of Nicholas D. Bailey, a successor thereto shall not have been elected, then such person whose term has so expired shall nevertheless continue to hold office until a successor shall be so elected.

SECTION 2. All Resolutions, or parts thereof, in conflict with the provisions of this Resolution are, to the extent of such conflict, hereby repealed.

SECTION 3. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
