RESOLUTION NO. R99-1657
A resolution authorizing the Metropolitan Mayor to enter into Agreement No. CSX-035898 with CSX Transportation for Metros Project No. 98-WG-4B, Antioch Pike 12" Water Main.
WHEREAS, the CSX Railroad Corporation ("CSX") owns and maintains railroad tracks in Davidson County; and
WHEREAS, the Metropolitan Department of Water and Sewerage Services (the "Department") needs to construct water lines in existing railroad rights-of-way in Antioch Pike at Valuation Station 21+95, Milepost ODL-3.61, for Project No. 98-WG-4B (the "Project"); and
WHEREAS, CSX proposes to permit the Department to construct water lines in railroad rights-of-way in connection with the Project pursuant to the terms of the agreement (the "Agreement") attached to this resolution as Exhibit A; and
WHEREAS, this agreement can be processed by resolution as authorized by Ordinance No. 098-1393; and
WHEREAS, funding for Project No. 98-WG-4B, Antioch Pike 12" Water Main, is included in the Capital Improvements Budget as No. 99-WC-0010.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Mayor or his designee is hereby authorized to execute Agreement No. CSX-035898, a copy attached.
SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
