RESOLUTION NO. R99-1644

A resolution authorizing the Director of Public Property to exercise an option to purchase real property (Map 85, Parcels 8 and 65 - Stones River Road) to be used by Parks and Recreation as part of the Stones River greenway system.

WHEREAS, it is the intent of the Board of Parks and Recreation and the Greenway Commission to expand the Stones River greenway system; and

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council."; and

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option to purchase certain property located in Davidson County as shown on Exhibit A and incorporated into this resolution by reference; and

WHEREAS, the Board of Parks and Recreation has considered and approved the purchase of the referenced site; and

WHEREAS, it is deemed in the best interest of the Metropolitan Government to approve the purchase of said property.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration is hereby authorized to exercise the option to purchase the property (Map 85, Parcels 8 and 65 - Stones River Road) as shown in Exhibit A and to execute the necessary documents pertaining thereto.

SECTION 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
