RESOLUTION NO. R99-1643

A resolution appropriating $18,584.25 to reimburse the Nashville and Eastern Railroad Corporation.

Whereas, the Nashville and Eastern Railroad Corporation operates the Nashville and Eastern Railroad for the Nashville and Eastern Railroad Authority, pursuant to contract; and'

Whereas, TCA sec. 65-11-113 provides that under certain circumstances railroads are required to install automatic flashing signals at railroad crossings and are entitled to reimbursement one third the cost of such signals from the State and one third from the county, municipality or metropolitan government within whose limits the crossing is located; and

Whereas the State Commissioner of Transportation has determined that the Nashville and Eastern Railroad Corporation's installation of automatic flashing signals at Crossing Number 348 679 T, at Merritt Street; within the limits of the Metropolitan Government, qualifies for such reimbursement; and

Whereas the total costs of the signal installation was $55,752.75; and

Whereas, the State has reimbursed the Nashville and Eastern Railroad Corporation the amount of $18,584.25 pursuant to the terms of TCA section 65-11-113,

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1 . The amount of $18,584.25 is appropriated (from Public Works Operation/Maintenance Fund) for payment of the Metropolitan Government's share of the cost of installing automatic flashing signals at Crossing Number 348 679 T and its payment to the Nashville and Eastern Railroad Corporation pursuant to the terms of TCA sec. 65-11-113 is hereby authorized.

Section 2. That this resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
