RESOLUTION NO. R99-1636

A resolution requesting CSX Transportation Systems to limit use of train whistles during late night hours.

WHEREAS, train tracks run throughout the entire area of the Metropolitan Government; and

WHEREAS, as a safety precaution trains emit signals through train whistles to warn vehicles and persons as such trains approach street and road crossings; and

WHEREAS, although this safety precaution is necessary, extended use of such signals during the nighttime hours disturbs residents within the area of such train tracks.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby requests CSX Transportation Systems, to the safest extend possible, reduce the duration of train whistles in residential areas between the hours of 11 p.m. and 7 a.m. so as not to disturb occupants of residential areas any greater than it is absolutely necessary.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to the operators of CSX Transportation Systems.

SECTION 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
