RESOLUTION NO. R99-1591

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of James E. Scales against The Metropolitan Government of Nashville and Davidson County for thirty thousand dollars ($30,000) and directing that this amount be paid from the Judgment and Losses Fund.

Whereas, James E. Scales is a Police Officer II with the Metropolitan Police Department; and

Whereas, James E. Scales, while assigned to the Warrants Division, midnight shift, contends that he was subjected to racially discriminatory treatment in violation of Title VII of the Civil Rights Act of 1964, as amended, and 42 USC Sect. 1981; and

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid for the Judgment and Losses Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of James E. Scales for the amount of thirty thousand dollars ($30,000) and that said amount should be paid from the Judgment and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
