RESOLUTION NO. R99-1569

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of William J. Lenox against The Metropolitan Government of Nashville and Davidson County for thirty thousand dollars ($30,000) and directing that this amount be paid from the Self-Insured Liability Fund.

Whereas, William J. Lenox was an employee of the Metropolitan Department of Parks and Recreation. At the time as his employment, he was serving in the capacity of recreation leader. His duties included supervising and coaching children in sports and other recreational activities; and

Whereas, on June 27, 1995, Mr. Lenox attended a soccer match at the Looby Community Center. After the soccer match, Mr. Lenox exited the bleachers and fell when part of the bleacher steps collapsed, causing him to land on his back and head.

Whereas, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid for the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of William J. Lenox for the amount of thirty thousand dollars ($30,000) and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
