RESOLUTION NO. R99-1568

A resolution authorizing the Metropolitan Government participation in a Design Phase Agreement with the U.S. Corps of Engineers.

WHEREAS, The Metropolitan Government of Nashville and Davidson County ("the Metropolitan Government") and the U. S. Army Corps of Engineers (the Corps") entered into an agreement pursuant to Resolution No. R96-245 to conduct a feasibility study regarding the Metro Center Levee Flood Damage Resolution Project ("the Project"); and,

WHEREAS, Resolution R98-1040 approved the Design Phase of the Project; and,

WHEREAS, due to real estate cost, geotechnical cost, no rise certification, increased survey costs and the accelerated schedule, the Corps had advised that there was a cost overrun in connection with said study, of which the Metropolitan Government's share is $43,300; and,

WHEREAS, approval of the additional $43,300 is in the best interest of the Metropolitan Government,

NOW THEREFORE, be is resolved by the Council of The Metropolitan Government of Nashville and Davidson county:

Section 1. The amount of $43,300 is approved for the Metropolitan Government's participation in the Design Phase overrun.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
