RESOLUTION NO. R99-1565
A resolution authorizing the Metropolitan Mayor to execute the necessary papers on behalf of the Metropolitan Government of Nashville and David-son County, Tennessee to apply for and secure a State of Tennessee Waterworks Construction Loan for the Cane Ridge and Joelton Water System Improvement Projects, and the Water Infrastructure Rehabilitation Program.
WHEREAS, The Metropolitan Government of Nashville and Davidson County proposes to construct projects known as:
1) Cane Ridge Water System Improvements 97-WG-66
Replacement of an existing pump with a larger pump and a new 16" water main down Nolensville Road from Old Hickory Boulevard to Bluff Road. Addition of a new 3 million gallon reservoir with site preparation for a second 2 million gallon reservoir on Kinhawk Hill.
2) Joelton Water System Improvements 97-WG-65
Add an additional pump at the Brick Church WPS and a new 1 million gallon reservoir.
3) Water Infrastructure Rehabilitation Program 98-WG-4
This program consists of rehabilitating water system in various areas of the Metropolitan Government; and
WHEREAS, the funding for these projects is authorized under Tennessee Code Annotated, Part 5-Waterworks Construction Loans, § 68-221-501 et.seq; and
WHEREAS, the Metropolitan Government has considered it to be in the public interest and to its benefit to apply for an secure such loan, and to authorize the Metropolitan Mayor to act on behalf of the Metropolitan Government.
NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. That the construction of said waterworks projects is essential to and in the best interest of the Metropolitan Government, and to the end that the following projects are needed at this time to service the identified areas: Cane Ridge Water System Improvements, Joelton Water System Improvements and Water Infrastructure Rehabili-tation Program.
SECTION 2: That the noted water work projects are to become an integral part of the water system or improve the existing water distribution system of the Metropolitan Government.
SECTION 3: That the Metropolitan Mayor, be and is hereby, authorized to make application on behalf of the Metropolitan Government to the State of Tennessee for the waterworks construction loans and to do all things necessary to the effectuation of securing the actual loans and in the event such application is approved, to accept the offer of the State of Tennessee, acting by and through the Department of Environment and Conservation, to provide such financial assistance to comply with such terms and conditions attendant to such loan offer as may be required pursuant to the aforementioned law and the rules and regulations promulgated pursuant thereto. The loan will be repaid out of the Water Extension and Replacement fund of the Metropolitan Department of Water and Sewerage Services.
SECTION 4: That the Metropolitan Mayor is hereby designated as the authorized representative of the Metropolitan Government for the purpose of furnishing to the State of Tennessee such information, data, and documents pertaining to the application for a waterworks construction loan as may be required, and otherwise, to act as the authorized representative of the applicant in connection with this application.
SECTION 5: That certified copies of this resolution be included as a part of the application for the waterworks construction loans to be submitted to the State of Tennessee.
SECTION 6: That this resolution is to be in effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
