RESOLUTION NO. R99-1520

A resolution accepting $67,000 in compromise and settlement of the Metropolitan Government's claim against Jones & Jones Construction Company.

Whereas, on October 24, 1998, employees of Jones & Jones Construction were working for the State on the Franklin Corridor drainage pipe enar the stadium campus. As they were trenching they broke the Metropolitan Government’s sixty inch sewer force main in Brown’s Creek; and,

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable, and recommends that the claim be compromised and settled in the amount of $67,000 and that these funds be deposited into the U.S.D. Fund 67311.105305.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to accept the amount of $67,000.00 in compromise and settlement of its claim against Jones & Jones Construction.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
