RESOLUTION NO. R99-1518

A resolution accepting $6,657.08 in compromise and settlement of the Metropolitan Government's claim against Dillingham & Smith Mechanical.

Whereas, on November 28, 1998, employees of Dillingham & Smith Mechanical replaced a water hearter in the Stahlman Building. Two weeks later the the area that was welded broke loose and flooded the mechanical room in the Stahlman Building causing property damage; and,

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable, and recommends that the claim be compromised and settled in the amount of $6,657.08 and that these funds be deposited into the U.S.D. General Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to accept the amount of $6,657.08 in compromise and settlement of its claim against Dillingham & Smith Mechanical.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
