RESOLUTION NO. R99-1509

A resolution setting a public hearing on a proposed amendment to the East Bank Redevelopment Plan.

WHEREAS, an East Bank Redevelopment Plan consisting of a text, exhibit and maps currently exists as previously approved by Ordinance Number 093-163; and

WHEREAS, the project is to be undertaken by the Metropolitan Development and Housing Agency in accordance with and in furtherance of the objectives of Article I, Sections 8 and 21 and Article II, Section 28 of the Constitution of Tennessee: ‘The Housing Authorities Law,’ Chapters 20 and 45, Public Acts of Tennessee of 1935 (1st Extraordinary Session), as amended; Chapter 114 of Public Acts of Tennessee of 1945, as amended; Chapter 181 of Public Acts of Tennessee of 1955 (said statutes now codified in Section 13-20-201 through 216, Tennessee Code Annotated); and

WHEREAS, Section 13-20-203, Tennessee Code Annotated, requires a public hearing on the amendment of any redevelopment plan prior to final approval being given by the Metropolitan Council; and

WHEREAS, the proposed amendment will be referred by the Metropolitan Development and Housing Agency to the Metropolitan Council for its review and approval; and

WHEREAS, a legal notice stating the date, time and place of said public hearing must be published in the newspaper of general circulation in the locality where the project is situated.

NOW , THEREFORE, BE IT RESOLVED BY THE METROPOLITAN COUNCIL OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That, at the meeting of the Metropolitan Council to be held on Tuesday, May 18, 1999, at 7:00 p.m. in the Metropolitan Council Chamber on the second floor of the Courthouse, the Council shall conduct a public hearing relative to amending the East Bank Redevelopment Plan in the manner required by law, at which hearing any person or organization desiring to be heard regarding the proposed plan will be afforded such an opportunity.

Section 2. That the Metropolitan Clerk be and is hereby directed to have published in The Tennessean, being the newspaper of general circulation in Nashville, Tennessee, in the issues of May 3rd, 10th, and 17th, 1999, a legal notice declaring a public hearing at the time and place aforesaid in the manner prescribed by law after approval of said legal notice by the Metropolitan Attorney.

Section 3. That the Metropolitan Development and Housing Agency be and is hereby authorized and directed to give written notice of the public hearing to at least one of the owners or at least one of the occupants of each parcel of property within the area affected by the proposed plan, as required by law.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
