RESOLUTION NO. R99-1506

A resolution requesting the Davidson County Delegation to the 101st Session of the General Assembly to adopt legislation to repeal Chapter 400 of the Private Acts of 1949 which created the Davidson County Farmers’ Market Commission.

Whereas, the Davidson County Farmers’ Market Commission ("Commission") was created and its powers were established by Chapter 400 of the Private Acts of 1949 and;

Whereas, the provisions of the private act are outdated and do not allow the Commission the necessary flexibility to operate a modern and successful Farmers’ Market; and

Whereas, by ordinance filed simultaneously with this resolution, the Commission is recommending that the Farmers’ Market Commission be made a commission under the Metropolitan Charter and Metropolitan Code of Laws, thus making the Private Act unnecessary.

Now, therefore be it resolved by the council of the Metropolitan Government of Nashville and Davidson County:

Section 1: That the Davidson County Delegation to the 101st Session of the General Assembly is hereby requested to file a private act that repeals Chapter 400 of the Private Acts of 1949.

Section 2: This Resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
