RESOLUTION NO. R99-1431

A resolution accepting $25,000.00 in compromise and settlement of the Metropolitan Government's claim against Huddleston Oil Company.

Whereas, on April 13, 1998, a gasoline tanker overturned on I-24; and,

Whereas, Tennessee Code Annotated, Section 58-2-304 allows the Metropolitan Government to collect all necessary and reasonable costs expended in cleaning up after hazardous material accidents; and,

Whereas, after investigation, the Department of Law believes that the settlement listed in Section 1 is fair and reasonable, and recommends that the claim be compromised and settled in the amount of $25,000.00 and that these funds be deposited into the U.S.D. General Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County that::

Section 1: The Metropolitan Department of Law is authorized to accept the amount of $25,000.00 in compromise and settlement of its claim against Huddleston Oil Company, and that these funds be deposited into the U.S.D. General Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
