RESOLUTION NO. R99-1429

A resolution approving an appropriation from The Metropolitan Government of Nashville and Davidson County to the Nashville Drug Court Support Foundation, Inc. for drug treatment and education.

Whereas, the Metropolitan General Sessions Court and State Trial Courts have entered into a Memorandum of Understanding for the colleciton and expenditure of excess DUI fine revenue; and

Whereas, pursuant to Tennessee Code Annotated §55-10-451 the proceeds from the increased portion of the fines for driving under the influence of an intoxicant may be deposited into dedicated county fund and shall not revert to the county general fund at the end of the fiscal year; and

Whereas, pursuant to Tennessee Code Annotated §55-10-452, these funds may be extended by appropriations to alcohol and drug treatment facilities licensed by the sate department of health, metropolitan drug commissions or other similar programs sanctioned by the Governor's Drug Free Tennessee program, whose primary mission is to educate the public on the dangers of illicit drug use or alcohol abuse or render treatment for alcohol and drug addiction or operate drug and alcohol programs for the homeless and indigent; and

Whereas, the Nashville Drug Court Support Foundation, Inc. is a drug treatment program that meets the requirements of Tennessee Code Annotated, §55-10-452; and

Whereas, The Metropolitan Government of Nashville and Davidson County has awarded a grant to the Nashville Drug Court Support Foundation, Inc. in an amount not to exceed twenty thousand ($20,000) dollars or the actual amount of fines collected, whichever is less, to provide for drug treatment and education; and

Whereas, it is deemed to be in the best interest of The Metropolitan Government to approve said grant.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That the grant appropriation from The Metropolitan Government of Nashville and Davidson County to the Nashville Drug Court Support Foundation, Inc. for the treatment and education of alcohol and drug addiction is hereby approved.

Section 2: That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
