RESOLUTION NO. R99-1411

A resolution setting a public hearing regarding the creation of a hospital authority for The Metropolitan Government of Nashville and Davidson County.

Whereas, Tennessee Code Annotated, § 7-57-201 authorizes The Metropolitan Government of Nashville and Davidson County to establish a metropolitan hospital authority; and

Whereas, prior to the establishment of a hospital authority, the creating municipality must approve a resolution calling a public hearing on the question of creating such an authority; and

Whereas, a legal notice stating the date, time and place of said public hearing must be published at least once each week for two consecutive weeks in a newspaper of general circulation, the last such publication to be at least one week prior to the date set for the hearing; and

Whereas, the Metropolitan County Mayor has, pursuant to his authority, called a special meeting for the purpose of conducting said public hearing and to adopt certain resolutions regarding the proposed metropolitan hospital authority.

Now, therefore, be it resolved by the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County, Tennessee, as follows:

Section 1. That, at the specially called meeting of the Metropolitan Council to be held on Tuesday, March 2, 1999, at 6:00 p.m. in the Metropolitan Council Chamber on the second floor of the Courthouse, the Council shall conduct a public hearing relative to the establishment of a metropolitan hospital authority in the manner required by law, at which hearing any person or organization desiring to be heard regarding the proposed hospital authority will be afforded such an opportunity.

Section 2. That the Metropolitan Clerk be and is hereby directed to have published in The Tennessean, being a newspaper of general circulation in Nashville and Davidson County, Tennessee, in the issues of February 15 and February 22, 1999, a legal notice declaring a public hearing will be held at the time and place aforesaid in the manner prescribed by law after approval of said legal notice by the Metropolitan Attorney.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
