RESOLUTION NO. R99-1404

A resolution authorizing the Metropolitan Department Of Law to compromise and settle the claim of Tennessee Imports against The Metropolitan Government of Nashville and Davidson County, for an amount not to exceed twenty-two thousand, nine hundred forty-two dollars and thirty cents ($22,942.30) and directing that this amount be paid from the self-insured liability fund.

Whereas, on November 14, 1998, Wayne Thomas, an employee of The Metropolitan Government of Nashville and Davidson County, Department of Fire, Emergency Ambulance Division, was involved in an accident while operating a vehicle owned by the Metropolitan Government. As a result of said accident, ten vehicles, owned by Tennessee Imports, were damaged; and

Whereas, the Metropolitan Department of Law after a full and complete investigation believes that the settlement listed in section 1 is fair and reasonable and recommends that this claim be compromised and settled and that this amount be paid from the Self-Insured Liability Fund.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Metropolitan Department of Law is authorized to compromise and settle the claim of Tennessee Imports for the amount of twenty two thousand, nine hundred forty-two dollars and thirty cents ($22,942.30) and that said amount should be paid from the Self-Insured Liability Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

Mr. President:

I move to amend Resolution No. R99-1404 as follows:

1.  Amend the first Whereas clause by substituting the name "Lori McCord"  for the name Wayne Thomas.
