RESOLUTION NO. R99-1402

A resolution authorizing the Metropolitan Mayor to enter into Agreement No. CSX-032936 with CSX Transportation for Metro’s Project No. 90-SC-157, Second Avenue Tunnel.

 WHEREAS, the CSX Railroad Corporation ("CSX") owns and maintains railroad tracks in Davidson County; and

WHEREAS, the Metropolitan Department of Water and Sewerage Services (the "Department") needs to construct sewer lines in existing railroad rights-of-way in Second Avenue near MilePost 000-185.15, for Project No. 90-SC-157 (the "Project"); and

WHEREAS, CSX proposes to permit the Department to construct sewer lines in railroad rights-of-way in connection with the Project pursuant to the terms of the agreement (the "Agreement") attached to this resolution as Exhibit A; and

WHEREAS, this agreement can be processed by resolution as authorized by Ordinance No. 098-1393; and

WHEREAS, funding for Project No. 90-SC-157, Second Avenue Tunnel, is included in the Capital Improvements Budget as No. 93-SC-0016.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor or his designee is hereby authorized to execute Agreement No. CSX-032936, a copy attached.

SECTION 2: That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
