RESOLUTION NO. R98-994

A RESOLUTION REQUESTING THE DAVIDSON COUNTY DELEGATION TO THE TENNESSEE GENERAL ASSEMBLY TO HAVE ADOPTED LEGISLATION THAT WOULD PERMIT THE METROPOLITAN GOVERNMENT TO REGULATE SMOKING IN RESTAURANTS AND OTHER PLACES OF PUBLIC ACCOMMODATION WITHIN THE AREA OF THE METROPOLITAN GOVERNMENT.

WHEREAS, the adverse effects of secondary smoke has been documented to pose serious health problems; and

WHEREAS, it is fitting and proper that urban communities such as the Metropolitan Government have the authority to enact regulations to regulate smoking, especially in restaurants and other confined areas where secondary smoke could have adverse effects.

NOW, THEREFORE, BE IT RESOLVED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Metropolitan County Council hereby goes on record as requesting the Davidson County Delegation to the Tennessee General Assembly to enact legislation that would enable the Metropolitan Council to regulate smoking in restaurants and other confined areas of public accommodation, whether privately or publicly owned.

SECTION 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to each member of the Davidson County Delegation.

SECTION 3. This Resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
